TNC Photography Usage Rights

The Nature Conservancy’s Aprimo Digital Asset Manager (DAM) photo archive uses usage rights categories & labels to explain how images can be used by Conservancy staff & partners. These are general descriptions for a very complex legal issue. If you have any questions, please contact the Photo Department for clarification:  tncphotos@tnc.org.

 

All Rights:

  • The Nature Conservancy owns the copyright or has been given the rights to use the photograph for all Internal and External Uses.

 

All Rights – No Commercial Use:

  • The Nature Conservancy has been given the rights to use the photograph for all Internal and External Uses, but not commercial use, eg. products for sale in public retail space, corporate partnership use, etc.

 

TNC License:

  • The Nature Conservancy has a worldwide, perpetual, irrevocable and fully paid license to the photograph for all TNC and Third Party uses, and the photographer retains copyright. TNC has the right to release photos to media and partner organizations, including corporate, in direct reference to the Conservancy or our work, but not for a corporation’s own commercial use.

 

Internal Rights:

  • The Conservancy has the right to use images in TNC-produced products, both print & digital. Printed products, include but are not limited to: factsheets, displays, banners, PSAs, annual reports, Nature Conservancy magazine, calendars, notecards, invitations, newsletters, mailings, outreach, education and legal materials. Digital products, include but are not limited to: TNC-owned websites, presentations, internal communication and TNC e-mail. Third party use is NOT allowed.

 

Limited Internal Rights:

  • The photographer/copyright holder has placed usage restrictions on the photograph for internal materials. Use in Nature Conservancy Magazine, Annual Report, Membership Calendar or for products used as giveaways or available for purchase is NOT allowed without photographer permission and usage fee negotiation.

 

Limited External Rights:

  • The photographer/copyright holder has placed usage restrictions on the Conservancy’s ability to share the photograph with third parties. Images may be shared to media and partner organizations in direct connection to the TNC project. Images may be used in online works, social media, printed materials. Corporate partner use is NOT allowed.

 

Public Domain:

  • The image is owned by the public instead of the photographer or the Conservancy. Public Domain work is free for anyone to use without paying royalties or asking permission.

 

Pay for Use:

  • TNC has no rights to the image and all use requires photographer permission and usage fee negotiation.
